As part of our commitment to transparency, we decided to highlight some key points in our Terms of Service:

- Dismiss accesses your email inbox to manage unsolicited emails.

- We use 3rd party technology to analyze email content in order to identify unsolicited emails

- There might be occasional misclassifications of spam, for which PixelGrid cannot be held liable.

- Contents of your emails are stored in order to show them to you inside the Dismiss app and for no other purposes

1. ACCEPTANCE OF TERMS

These Terms of Service("Terms") represent the complete contract between you and our company PixelGrid, located at 30-32 boulevard Sebastopol, 75004, Paris, France, provider of Dismiss (hereafter referred to as the "Service"). By accessing and using the Service, you agree to be bound by these Terms. If you disagree with any part of these Terms, you may not use this Service.

2. USE OF THE SERVICE

Our Service confirms to remove unsolicited emails from your inbox, sending response emails where necessary. Accordingly, you approve our Service to access your email server, respond to emails, and manage your email content.

3. PRIVACY & CONFIDENTIALITY

Confidentiality is paramount to us. Though we access your inbox while providing our Service, we assure you that we will treat the content of your emails as confidential. The content will not be shared, sold, or disclosed to any third parties, except for classification purposes and when legally required.

4. CONSENT TO ACCESS AND SEND EMAILS

By agreeing to these Terms, you give us permission to access, sync, manage, and respond to emails from your email server to effectively provide our Service. We utilize secure data channels to ensure safety during these processes.

5. IMPROVEMENT OF SERVICES

To continually optimize our services, we may use the content of the emails that are marked as unsolicited to enhance our algorithm, ensuring better discrimination between spam and non-spam emails.

6. DISCLAIMER OF ACCURACY

While our Service strives to identify unsolicited emails accurately, there may be instances where legitimate emails could be wrongly classified as spam. We do not assume responsibility for such misclassifications and any subsequent consequences.

7. USER RESPONSIBILITIES

You are responsible for maintaining your account's confidentiality and for any activities that occur under your account. Kindly notify us instantly on any unauthorized use of your account.

8. CANCELLATION, TERMINATION AND REFUNDS

You may cancel your account anytime. To terminate this agreement and discontinue the use of our Service, you must delete your account permanently.

You may request a refund up to 14 days after your last payment. To request your refund, you must write to us at contact@dismiss.io

9. MODIFICATIONS TO THE SERVICE

We maintain the right to modify or discontinue, temporarily or permanently, the Service without notice or liability to you.

10. DISCLAIMER OF WARRANTIES

Our Service is offered on an "AS IS" and "AS AVAILABLE" basis for use at your own risk, with no warranties.

11. LIMITATION OF LIABILITY

Under no circumstance shall we be liable for any damage, loss, or injury arising from the use or inability to use our Service. Under no circumstance shall we be liable for any email that may have been inappropriately marked as unsolicited and the consequences of that.

12. GOVERNING LAW & JURISDICTION

These Terms are administered by and interpreted following the laws of France, and you submit to the jurisdiction of the state and federal courts in Paris for resolution of any disputes.

13. CHANGES TO THE TERMS

We hold the right to revise these Terms at any point. Your continued use of our Service following the post of changes constitutes your acceptance of the modifications.

By creating an account with us, you acknowledge that you have read these Terms of Service, understand them, and agree to be bound by them.
